The Prosecutor General of the Republic of Brazil Paulo Gonet opposed the possible granting of house arrest to former President Jair Bolsonaro in a legal opinion submitted to the Supreme Court.


The opinion stated that the facility where the far-right leader is serving his 27-year prison sentence for coup-mongering has the conditions to offer him medical care 24 hours a day and has an emergency unit.

Last week, defense attorneys for the former far-right president filed a request seeking to transfer Jair Bolsonaro to house arrest over health concerns. Bolsonaro has been detained since January 15 at a police facility designated for prisoners under special custody, located within a penitentiary complex.

Gonet based his opinion on a medical report from the Federal Police, which concluded that the chronic diseases Bolsonaro suffers from are under clinical and medicinal control, and that it is not necessary to transfer him to a hospital at the moment.

He further recalled that the high court had rejected Bolsonaro’s previous bids for house arrest, citing both the risk of escape and his failure to comply with earlier judicial orders.

Likewise, he authorized his immediate transfer to a hospital in case of emergency, the possibility of offering him physiotherapy sessions at times indicated by his doctors, and providing him daily with a special diet, which will be brought to the police facility by a person designated by the defense.

The former president was sentenced in September by the Supreme Court for leading a plot to try to “perpetuate himself in power” after losing the 2022 presidential election to Luiz Inacio Lula da-Silva, and initially served the sentence under house arrest.
