The defense of former Argentinian President Cristina Fernández de Kirchner presented a formal addendum to the UN Human Rights Committee on Tuesday, requesting the immediate suspension of the perpetual ban on holding public office and, alternatively, of her six-year prison sentence.

The filing incorporates new facts and evidential elements to reverse the judicial sanction while the merits of the international claim are analyzed, according to the defense. Among the points denounced, the lawyers cited acts of intimidation and harassment against the former president. The document mentions public statements by judges who intervened in the Vialidad case, restrictive measures on her assets, and social media posts by President Javier Milei directed at her.

It also challenges the action against the apartment at 1111 San José Street, where Kirchner is serving house arrest. For the defense, these circumstances violate due process guarantees and directly affect the legitimate right to file claims and defenses before international human rights bodies.

On evidence, the lawyers incorporated new official documentation on the destination of funds from the so-called Fuente 14 and the SISVIAL road trust, elements rejected in the original trial. Official spreadsheets provided in August 2026 by an auditing official in the Cuadernos case allowed the defense to commission an independent accounting report.

The addendum further challenges the media dissemination of audiovisual material from the 2018 raid on the leader’s Recoleta home, calling it a violation of privacy.

The legal move carries political weight ahead of the 2027 presidential elections, after Máximo Kirchner confirmed his mother maintains the willingness to run if she recovers full political rights through a favorable resolution from the UN body.
