Argentine Groups Seek Arrest of Netanyahu During September Visit Over Alleged War Crimes

Argentine labor and human rights organizations have formally requested the detention of Israeli Prime Minister Benjamin Netanyahu during his upcoming visit to Argentina, citing alleged war crimes, genocide, and crimes against humanity.

ATE Capital, represented by Secretary General Daniel Catalano, and H.I.J.O.S. Capital submitted a complaint to Federal Criminal and Correctional Court No. 7, led by Sebastián Casanello, and to Prosecutor Guillermo Marijuan. The filing requests the immediate detention of Netanyahu in line with ICC orders issued on November 21, 2024, holding him responsible for crimes against the Palestinian people.

The complaint also invokes the principle of aut dedere aut iudicare—extradite or prosecute—so that, if Netanyahu is not transferred to the ICC, he may face trial in Argentine courts for the alleged crimes. The organizations emphasized that Argentine authorities must comply with obligations under the Rome Statute and the Geneva Conventions to prevent impunity.

The complaint references reports by the UN Special Rapporteur on the Occupied Palestinian Territories, documenting systematic violence in Gaza since October 7, 2023, including forced displacement. It also cites the International Independent Commission’s findings on Israeli Defense Forces actions against Palestinian protesters, resulting in 184 deaths and over 6,100 injuries.

In their joint statement, ATE Capital and H.I.J.O.S. Capital stressed that “in a context where powers such as the United States have attempted to delegitimize the ICC, this complaint reaffirms the commitment to international justice and the end of impunity for mass human rights violations. For justice, memory, and truth, we demand the cessation of hostilities and accountability for those responsible.”

The filing underscores Argentine civil society’s commitment to international legal obligations, bringing attention to accountability for alleged human rights violations in Palestine as Netanyahu’s visit approaches.
