In a decisive move, Bolivia’s First Constitutional Chamber of the Beni Departmental Court of Justice issued a precautionary measure this Thursday suspending the Third System Movement’s (Movimiento Tercer Sistema, MTS) legal status.
The ruling prohibits the Supreme Electoral Tribunal (TSE) from authorizing the party’s participation in the general elections scheduled for August 17, directly impacting the political trajectory of Andrónico Rodríguez, a key figure in the Popular Alliance.
The court’s resolution emphasizes the need to prevent “imminent, irreparable, or irremediable harm” to constitutional rights by suspending MTS’s participation and candidate registration until the TSE complies with Constitutional Resolution 051/2025 issued on May 26.
This measure, described as a “complementation and amendment,” clarifies procedural ambiguities without altering the core decision. The electoral authority was instructed to implement the suspension immediately and notify all involved parties, ensuring swift enforcement of the constitutional mandate.

By virtue of the Compliance Action filed by Peter Erlwein Beckhauser against Oscar Hanssenteufel Salazar in his capacity as President of the Supreme Electoral Tribunal of Bolivia.
It is established that the plaintiff, Peter Erlwein Beckhauser, submits a petition for clarification, amendment, and supplementation on three points;
1.- He requests clarification, supplementation, and amendment of the aforementioned resolution issued by this Chamber, which GRANTS the protection requested through this Compliance Action, but does not clearly establish that immediate compliance is required with the duty set out in subsection (e) of paragraph I of Article 58 of Law No. 1096 of September 1, 2018, for failure to comply with five (5) Resolutions issued by the Supreme Electoral Tribunal by the political party Third System Movement – MTS.

The suspension stems from MTS’s failure to comply with five resolutions concerning its board of directors, a situation brought to light by Erlwein Beckhauser, who filed the enforcement action citing irregularities in the party’s internal renewal process.
